CONCERNING
AMENDMENT TO THE REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE No. P-38/BC/2007 CONCERNING PROCEDURE TO RELEASE IMPORT GOODS FROM CUSTOMS AREA TO BE STACKED ON BONDED STORAGE YARD BY USING ELECTRONIC DATA EXCHANGE SYSTEM

DIRECTOR GENERAL OF CUSTOMS AND EXCISE,

Considering:

• a. that to implement certainty to release importing goods from Customs Area to be stacked on Bonded Storage Yard, by using electronic data interchange, it is needed to amend certainty of effective date that is decided in Regulation of the Director General of Customs and Excise No. P-38/BC/2007 concerning Procedure to Release Importing Goods from Customs Area to be Stacked on Bonded Stacking Yard by using Electronic Data Exchange System;
• b. based on consideration as described in a., it is needed to stipulate Regulation of the Director General of Customs and Excise concerning Amendment to Regulation of the Director General of Customs and Excise No. P-38/BC/2007 concerning Procedure to Release Importing Goods from Customs Area to be Stacked on Bonded Stacking Yard by using Electronic Data Exchange System;

In view of:

• 1. Law No. 10/1995 concerning Customs (Republic of Indonesia Statute Book No. 75/1995, Supplement to Statute Book No. 3612), that is amended by Law No. 17/2006 (Republic of Indonesia Statute Book No. 93/2006, Supplement to Statute Book No. 4661);
• 2. Law No. 11/1995 concerning Excise (Republic of Indonesia Statute Book No. 76/1995, Supplement to Statute Book No. 3613), that is amended by Law No. 39/2007 (Republic of Indonesia Statute Book No. 105/2007, Supplement to Statute Book No. 4755);
• 3. Government Regulation No. 33/1996 concerning Bonded Stacking Yard (Statute Book No. 50/1996, Supplement to Statute Book No. 3638); that is amended by Government Regulation No. 43/1997 (Statute Book No. 90/1997, Supplement to Statute Book No. 3717);
• 4. Government Regulation No. 44/2003 concerning Tariff and Kind of Non Tax State Revenue in Directorate General of Customs and Excise Environment (Republic of Indonesia Statute Book No. 95/2003, Supplement to Statute Book No. 4313);
• 5. Decision of the Minister of Finance No. 101/KMK.05/1997 concerning Customs Declaration, that is amended the last by Regulation of the Minister of Finance No. 48/PMK.04/2005;
• 6. Decision of the Minister of Finance No. 291/KMK.05/1997 concerning Bonded Zone that is amended for many times, the last by Regulation of the Minister of Finance No. 101/PMK.04/2005;
• 7. Decision of the Minister of Finance No. 399/KMK.01/1996 concerning Bonded Storage;
• 8. Decision of the Minister of Finance No. 123/KMK.05/2000 concerning Entrepot for Exhibition;
• 9. Decision of the Minister of Finance No. 128/KMK.05/2000 concerning Duty Free Shop.

HAS DECIDED:

REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE CONCERNING AMENDMENT TO THE REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE No. P-38/BC/2007 CONCERNING PROCEDURE TO RELEASE IMPORT GOODS FROM CUSTOMS AREA TO BE STACKED ON BONDED STORAGE YARD BY USING ELECTRONIC DATA EXCHANGE SYSTEM

Article I

To amend Article 21 of Director General of Customs and Excise No. P-38/BC/2007 concerning Procedure to Release Import Goods from Customs Area to be stacked on Bonded Storage Yard by using Electronic Data Exchange System. Article 21 become as follows:

"Article 21

Certainty about procedure to submit electronic data of customs declaration by using Electronic Data Exchange system in Regulation of the Director General of Customs and Excise No. P-38/BC/2007 is in many steps, as follows:

a. Bonded Storage Yard in control of Purwakarta Customs and Excise Control and Service Office is effective from August 1, 2008;

b. Others Bonded Storage Yard in control of Customs Office that use Electronic Data Exchange is effective from October 1, 2008."

Article II

This Regulation of the Director General is effective from the date specified.
